Cadastral surveying (Liegenschaftsvermessung)

Requirements for parcelling without a local survey (Sonderungsvoraussetzungen)

Requirements for forming parcels (Flurstücke) without a local survey (Sonderungsvoraussetzungen)

In suitable cases, parcels can also be formed without a local survey (Sonderung). Under No. 4.1.5.3 LiVermVV M-V, this is possible if the following requirements are met:

  1. all existing boundary points of the part of a plot to be separated (Trennstück) and of the boundaries into which it is to be integrated must have been determined in accordance with § 29(1) GeoVermG M-V,
  2. the positions of all boundary points named under a) must meet the quality requirements listed in No. 4.1.1.8 a),
  3. the applicant must declare that they waive the right to have the boundary points shown on site,
  4. the property owner, the holder of a heritable building right (Erbbauberechtigte) and, if applicable, the buyer must be informed of the obligation to have the boundary marked later, unless boundary marking can be omitted in accordance with § 30(2) GeoVermG M-V, and
  5. none of the planned parcel boundaries runs through a building, unless the building is to be demolished. The planned demolition can be proven, for example, by a legally effective declaration to the building authority that the use is given up, or by legally binding planning documents.

Under No. 4.1.5.4 LiVermVV M-V, parcelling without a local survey is permitted without the requirements of No. 4.1.5.3 if the planned parcel boundaries

  1. are to serve the appropriate division within road, path or water parcels between a maximum of two future neighbouring boundary points (a polygonal course over several planned boundary points is not permitted), and it is ruled out that the new parcels are to be made available for sale or transfer,
  2. are only to remain in place in a land readjustment or consolidation procedure (Bodenordnungsverfahren) until the new legal situation takes effect,
  3. are to reverse a merger of parcels (Verschmelzung) or
  4. serve to form parcels on land that has not yet been recorded in the cadastre.
