Legal status

Can you build here?

The bylaw is legally binding. It sets out what may be built on the plots in its area. You find the details in the plan drawing and in the text part.

Whether your own project fits the plan is decided by the local building authority (untere Bauaufsichtsbehörde). You can ask them in advance with a preliminary building enquiry (Bauvoranfrage).

The municipality drew up the bylaw using the simplified procedure under § 13 BauGB.

What is a supplementary bylaw?

It adds single pieces of land from the outlying area to the built-up part of a town or village, if the buildings next to them shape their character (§ 34 Abs. 4 Satz 1 Nr. 3 BauGB).

Which survey you need and when

For a building project in this area, you usually need these surveys.

  1. Before you buy: clear up the boundaries

New plots are often created without boundary stones. Agree in the purchase contract who pays for forming the new land parcels and for the final boundary marking (Schlussabmarkung). Boundaries and plots

  2. For the planning: topographic survey plan

The basis for your architect, with boundaries, heights and the rules of the plan (Lage- und Höhenplan). Topographic survey plan

  3. For the building application: site plan

It is required by § 7 BauVorlVO M-V. If buildings or their spacing areas (Abstandsflächen) come closer than 0.5 m to the boundary, an official surveying body must make it, for example a publicly appointed surveying engineer (ÖbVI).

  4. Before building starts: setting out

We transfer your project to the plot with rough and precise setting out and give the building company fixed height points. Surveying for your new house

  5. After completion: official building survey

It is required by § 28 GeoVermG M-V. If we made the site plan and the setting out, the fee is 10 % lower. Official building survey (Gebäudeeinmessung)
