Legal status
Can you build here?
Usually not yet under this development plan. The municipality is still drawing it up. The last known step is: Decision to draw up the plan. Until it comes into force, the law that applied before still decides what you may build. In some cases a project can be approved while the plan is still being drawn up (§ 33 BauGB).
When the development plan will come into force, and whether its content will still change until then, nobody can say for sure in advance.
What is a qualified development plan?
It sets at least the type and extent of building use, the parts of the plots that may be built on and the local roads and paths. A project is allowed if it does not go against these rules and access and services are secured (§ 30 Abs. 1 BauGB).
Which survey you need and when
While the plan is being drawn up and later during construction, you usually need these surveys.
-
Now: create the basis
A topographic survey plan (Lage- und Höhenplan) shows boundaries, existing features and terrain. It is the basis for the plan and for first designs. Topographic survey plan
-
With the roads and services: form the plots
We divide the land into building plots according to the plan and form the new land parcels. Dividing land
-
For each building project: from site plan to building survey
Once the plan is in force, you need a site plan for the building application, setting out and, after completion, the official building survey. Surveying for your new house
