Legal status
Can you build here?
The development plan is legally binding. It sets out what may be built on the plots in its area. You find the details in the plan drawing and in the text part.
Whether your own project fits the plan is decided by the local building authority (untere Bauaufsichtsbehörde). You can ask them in advance with a preliminary building enquiry (Bauvoranfrage).
What is a qualified development plan?
It sets at least the type and extent of building use, the parts of the plots that may be built on and the local roads and paths. A project is allowed if it does not go against these rules and access and services are secured (§ 30 Abs. 1 BauGB).
Which survey you need and when
For an energy facility in this area, you usually need these surveys.
-
To secure the land: land parcels and owners
We find out which land parcels the project touches and who owns them, from the real estate cadastre (Liegenschaftskataster) and the land register (Grundbuch). Surveying for wind and solar farms
-
For the planning: topographic survey plan
Boundaries, existing features and terrain, for large areas also as a terrain model from a drone flight.
-
For the permit: site plan
Whether it is a building application or an application under the Federal Immission Control Act (Bundes-Immissionsschutzgesetz): the site plan under BauVorlVO M-V is part of it, if needed with the documents for a public easement (Baulast), for example for an access road.
-
Before building starts: setting out
Foundations, fence, module rows, crane pads and access roads, on request during construction.
-
After completion: building survey and as-built records
Official survey where it is required, for example for wind turbines, plus an as-built plan and cable routes. Official building survey (Gebäudeeinmessung)
