Can you build here?

Not under this development plan any more. What may be built on the land depends on a newer plan. If there is none, the general rules of the Federal Building Code (Baugesetzbuch) apply: for built-up areas (Innenbereich, § 34 BauGB) or for outlying areas (Außenbereich, § 35 BauGB).

You get a binding answer with a preliminary building enquiry (Bauvoranfrage) at the local building authority (untere Bauaufsichtsbehörde).

The municipality drew up the development plan using the accelerated procedure for inner development under § 13a BauGB.

What is a simple development plan?

It does not contain all the rules of a qualified development plan. Where it says nothing, the general rules for built-up areas (Innenbereich) or outlying areas (Außenbereich) apply (§ 30 Abs. 3 BauGB).

The development plan sets which kind of zone applies and so what may be built and run there. A general residential area (WA) is mainly for housing; shops and non-disturbing craft businesses that serve the area are allowed too. A mixed area (MI) combines housing and business, a commercial area (GE) is mainly for companies.

The floor area ratio says how much floor area is allowed compared with the plot area. A GRZ of 0.4 means buildings may cover 40 % of the plot. Garages, parking spaces with their driveways and ancillary buildings may usually exceed this by half, up to 0.8. The calculation is part of the documents for the building application.

The part of a plot where buildings may stand. It is limited by building lines that buildings must not cross (Baugrenze) or lines on which they must be built (Baulinie). Garages and ancillary buildings may be allowed outside it unless the plan says otherwise.
